Résumé

La gouvernance des droits est un projet complexe d'exercice d'un pouvoir discrétionnaire éthique dans une société systémiquement contraire à l'éthique. Cet article remet en question l'efficacité des droits en tant qu'objets de gouvernance en exposant les tensions au sein de la Convention relative aux droits de l'enfant (CRC) et de la Convention relative aux droits des personnes handicapées (CRPD), ainsi qu'entre elles. Ancrée dans une perspective critique des études sur le handicap, je remets en question la possibilité de respecter le handicap comme une partie naturelle de la diversité humaine tout en proposant simultanément que les enfants handicapés ont droit à une intervention. Qui gouverne la définition de la « santé », du « développement », de l'« accès » ou de l'« intérêt supérieur » ? J'interroge la fonction des discours fondés sur les droits dans une culture mondiale qui n'a pas encore pleinement abandonné le projet de l'eugénisme. Je présente des relations troublantes entre chercheur et sujet dans des études de cas portant sur des technologies portables destinées à l'intervention auprès de l'autisme, en tant que terrain d'analyse stimulant pour l'éthique de ces interventions. J'appelle à nous interroger sur qui bénéficie réellement lorsque nous nous engageons dans la production de « corps susceptibles d'être inclus » plutôt que dans la déconstruction d'environnements excluants.

The governance of rights is a complex project of exercising ethical discretion in a systemically unethical society. This paper troubles the efficacy of rights as governable by exposing tensions within and between the Convention on the Rights of the Child (CRC) and the Convention on the Rights of Persons with Disabilities (CRPD). Grounded in a critical disability studies perspective, I question the possibility of respecting disability as a natural part of human diversity while simultaneously proposing that disabled children have a right to intervention. Who governs the definition of “health”, of “development”, of “access”, or of “best interests”? I interrogate the function of rights-based discourses in a global culture that has yet to fully abandon the project of eugenics. I present disturbing relations between researcher and subject in case studies of wearable technologies for autism intervention as a challenging site of analysis for the ethics of these interventions. I call us to question who truly benefits when we engage in the production of ‘includable bodies’ rather than the deconstruction of exclusionary environments.
